These enrollment conditions, together with the online order form sent upon acceptance, constitute the contract between ICTESS INGENIERIA E INNOVACION SL (hereinafter, the Center) and any user who makes a purchase or enrolls in training programs (hereinafter, the Client or Student) through https://ictess.us (hereinafter, the Website).
When submitting your request, you must check the box "I accept the General Enrollment Terms" that appears next to the form. By checking this box, the Client declares that they have read these terms, accepts them, and gives their express consent to the entire content of the contract in the version published at the time of acceptance, committing without reservation to its fulfillment.
1. Identification of the Parties
In compliance with Article 10 of Spanish Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, the Center provides the following information as the contracting party that owns the Website:
- ICTESS INGENIERIA E INNOVACION SL
- Address: Avenida Aragón 30 ESC. 1 8 5, 46021, Valencia (Valencia), Spain
- Tax ID (NIF): B25951955
- Email: admission@ictess.com
The Client is identified through the data provided in the order or enrollment form, being responsible for its truthfulness, currency and accuracy. The Client declares that they are over 18 years of age, have the legal capacity to enter into contracts, and act on their own behalf as a natural person or on behalf of a legal entity. In the latter case, the Client expressly declares that they have sufficient authority for such representation. The Center may decline order requests or cancel client accounts when the data provided is inaccurate, false or incomplete.
2. Purpose
This contract governs the terms and conditions applicable to the Client's contracting of the Center's training services through enrollment in the program selected by the Client from those offered on the Website. These conditions are formulated in accordance with Spanish Royal Legislative Decree 1/2007, of November 16 (General Law for the Defense of Consumers and Users), Law 7/1996, of January 15 (Retail Trade Regulation), and Law 34/2002, of July 11 (Information Society Services and Electronic Commerce).
3. Description of Products and Services
The Website offers training programs (Courses and Master's programs) in distance or online mode. Distance-mode programs are those in which the student is provided with study materials to complete the course, and must send the corresponding evaluation tests to the Center by postal mail. In online mode, the study materials are available in digital format through an online platform on which the Student can study, progress through the course and submit the evaluation tests.
The Student will have access to a tutoring service provided by the Center's teaching and technical staff to resolve questions, guide their study, correct exercises and tests, and provide supplementary study material during the training period.
Upon completion, the Student must have passed the evaluation criteria indicated in advance on the corresponding program page. The teaching staff has exclusive authority over the passing or failing of the various tests and projects. Under no circumstances does payment for the program by itself entail the issuance of the certificate.
The Student will have a maximum period that will be communicated by the Center at the start of the program. Once that period ends, the Student will have a free extension. If that extension passes without meeting the requirements, the program will be considered concluded without the issuance of a qualification, and access to the online campus will change to strictly consultation mode.
4. Purchase Process
Contracting a program is done through the Website by completing the form with the required data, selecting the payment method and accepting these conditions through the box provided for that purpose. The contract will be formalized upon receipt of the request by the Center.
At the end of the process, the Center will send an acknowledgment of receipt by email. A training technician will contact the Client to confirm all enrollment details, the payment method and the shipment of materials if applicable.
5. Shipping
If the program includes study materials in physical format, they will be shipped by courier within 24 to 48 hours of enrollment confirmation. The price includes VAT, transport and home delivery. Clients outside the national territory must check the shipping conditions in advance.
6. Withdrawal
The Website informs of a withdrawal period of 30 calendar days from the date of enrollment or, where applicable, from the date of receipt of the study materials in distance mode.
This withdrawal period refers to voluntary withdrawal without force majeure by the Student, provided the program has not started and no course material has been delivered. To exercise this right, the Student must notify the Center within the indicated period, sending a Withdrawal Form to admission@ictess.com stating the reason.
If, due to duly proven force majeure, the Student is unable to start the classes covered by the contract before they begin, the Center will refund the full amount actually paid.
When study materials in physical format have been delivered, the Client must return them in perfect condition, with the return costs and any damage to those materials being at the Client's expense. The Center may withhold the refund until the materials are received.
Once the right of withdrawal has been exercised, the refund will be processed within a maximum of 30 calendar days, cancelling the enrollment and the Student's access to the platform and tutoring service.
If the Student had fully completed the program and submitted the evaluation tests before notifying withdrawal, this right will not apply, in accordance with Article 103 a) of Royal Legislative Decree 1/2007.
6 bis. Withdrawal After the Program Has Started
If, once the program has started and the training material has been delivered, a duly justified force majeure event occurs that prevents the Student from continuing, the Center will make a partial refund proposal, taking into account the amount paid by the Student up to the date the force majeure occurs, the degree of progress in the program, the Student's attendance and the Center's contribution, among other related variables.
If the Student wishes to voluntarily withdraw from the program once it has started, they must request their withdrawal expressly and in writing to the Center. A voluntary withdrawal request will not entail the refund of the amount paid for the training, unless such withdrawal is duly justified and the reasons are disproportionate to the Student's reasonable expectation of the program, taking into account the information previously provided about the training.
Notwithstanding the above, in cases where a refund is appropriate as indicated in the previous paragraph, the Center will refund the amount after deducting processing costs, delivery of documentation and the training period already provided.
Under no circumstances will the Student's voluntary withdrawal exempt them from paying amounts already due and pending payment according to the installment plan agreed at the time of enrollment.
7. Internship Program. Conditions
The Center makes available to its students, as an additional service to the training program, an internship program to improve the Student's practical training and facilitate their entry into the job market. Such services will be subject to specific conditions that the interested party must accept prior to their provision. Under no circumstances will the Client be subject to payments or other obligations for services other than those covered by these conditions without their prior express consent.
The completion of internships may be limited by the Student's personal or professional situation, or by the conditions required by the host entities. Nevertheless, the Center will make its best efforts to find an alternative.
8. Payment Methods
Card: Visa, 4B or MasterCard through the Website's payment gateway.
Bank transfer: To the account provided by the sales team. Checks or similar instruments are not accepted.
Cash on delivery: Payment to the carrier upon receipt of the order (distance mode only).
PayPal: Through the secure payment gateway integrated into the Website.
The price of each program includes all applicable taxes and shipping costs. Where offered, the total price may be paid in installments with no interest or additional costs for the Student.
Once the thirty days provided for the exercise of the right of withdrawal have passed, both the Student and whoever commits to payment are jointly and severally obligated to pay the full contracted amount. Failure to pay an installment entitles the Center to claim the full outstanding debt, as well as the banking or management costs arising from the breach, which may result in the temporary suspension of the Student's access to the content or, where applicable, the cancellation of the enrollment without the right to a refund.
9. Intellectual Property
All elements of the Website, the training platform and the programs are the exclusive property of the Center, or the Center has authorization or a license from the rights holders. By contracting a program, the Client receives a license to use the content on a limited, non-exclusive and non-transferable basis.
The Client may not, except with the express written consent of the Center: provide or reveal their access credentials to third parties; allow third parties access to the course content; or distribute, communicate, reproduce or copy the course content on any medium. Non-compliance will be grounds for early and automatic termination of the contract, without prejudice to any applicable legal liability.
10. Other Centers
Entities wishing to contract programs from the Website to offer them to their own clients must request express authorization from the Center. Under no circumstances may they include in their catalogs the Center's programs that are accredited or taught jointly with other institutions.
11. Language
This contract is formalized in Spanish, which will prevail in the event of conflict over any translated version the Center may publish.
12. Data Protection
In accordance with the General Data Protection Regulation (EU) and Spanish Law 3/2018, of December 5, the Student's data will be incorporated into the processing system of ICTESS INGENIERIA E INNOVACION SL (NIF: B25951955), for the purpose of handling their inquiries and managing the contractual relationship arising from enrollment.
The data will be processed lawfully, fairly, transparently and kept up to date. The Student may exercise their rights of access, rectification, limitation, deletion, portability and objection by contacting admission@ictess.com. They may also contact the competent supervisory authority to file any complaint they consider appropriate.
13. Offers and Promotions
The Client consents to receiving information, offers and promotions about other programs of the Center or of collaborating entities. In any case, promotional emails will include the option to cancel future commercial communications.
14. Applicable Law and Jurisdiction
These conditions are governed by Spanish law. For the resolution of any dispute, the Courts and Tribunals of the city of Valencia (Spain) will be competent. If the Client qualifies as a Consumer or User under the General Law for the Defense of Consumers and Users, the resolution will be handled by the Courts and Tribunals of the User's domicile.
If any provision of this contract is declared void or without effect, the remaining provisions will retain their validity.
